What are My Rights?
As a family member who has lost a loved one as a result of a fatal work accident, you may have a right to receive compensation through a workers' compensation claim. The Delaware workers' compensation system provides a type of compensation, called a death benefit, which is provided to dependents, as defined by Delaware law.
Death benefits are a weekly benefit. The amount of death benefits paid increase as the number of dependants increase, but there is a cap on the total amount of death benefits that may be paid. Benefits for dependent children typically cease at the age of 18, but may continue if the child is mentally or physically disabled. In addition, death benefits may be paid up to the age of 25 for a dependant child that is a full-time student.
In addition to weekly death benefit payments, a dependent family member may also receive up to $3,500 toward necessary funeral expenses.
