Disability and Wage Benefits in Workers' Comp Cases

The Delaware workers' compensation system was created to provide protection to workers who have suffered work-related injuries or occupational diseases. There are two basic forms of benefits that are provided by the Delaware workers' compensation laws: medical benefits and wage benefits.

If you or a loved one has suffered a workplace injury, the experienced Delaware disability benefits lawyers at The Freibott Law Firm, P.A., can help. We aggressively pursue maximum compensation on behalf of each of our clients. Our attorneys have the experience to handle even the most complex workers' compensation claims.

The medical benefits provided by the workers' compensation system are comprehensive and provide coverage for necessary doctor visits, treatment, surgery and other necessary medical care. Visit our medical benefits page to learn more.

Helping You Understand Wage and Disability Benefits

The wage or disability payments that are available under the worker's compensation system include:

  • Temporary total disability benefits: If you are totally disabled for a temporary period of time, you may receive temporary total disability benefits that are equal to two-thirds of your pre-injury wages (subject to a maximum cap).
  • Temporary partial benefits: If you are unable to return to your existing job or return to work full time, you may be entitled to receive temporary partial disability payments for a period of up to 300 weeks. The amount of benefits you receive is two-thirds of the difference between your pre-injury wages and your return-to-work wages.
  • Permanent impairment benefits: If you have suffered a permanent impairment, such as a loss of limb or permanent damage to your neck, back, arms or legs, you may be entitled to receive permanent impairment benefits. Visit our page on permanent impairment to learn more.
  • Scarring or disfigurement benefits: Workers who have suffered serious burns, scars, loss of limb, visible limp or other disfiguring injuries may receive disfigurement benefits for a period of up to 150 weeks. Visit our page on scarring or disfigurement benefits to learn more.
